Permitted Payments and Tenancy Information:

Phoenix Lettings are a member of The Property Ombudsman Scheme for Redress purposes. We have Client Money Protection through CMP Client Money Protect.

In accordance with the Tenant Fee Ban which came into force on 1st June 2019 please find below the full information relating to any costs and permitted payments involved in renting a property through Phoenix Lettings and Property Management Ltd.

Holding Deposit (per tenancy):

This is equal to 1 weeks rent – Please be aware that this will be withheld if any relevant person (including any guarantor(s)) withdraw from the tenancy, fail a Right-to-Rent check, provide materially significant false or misleading information, fail to take reasonable steps to enable the completion of references within the needed timescale or fail to sign their agreement (and/or Deed of Guarantee) within 15 calendar days (or other Deadline for Agreement as mutually agreed in the Holding Deposit Form)

Security Deposit (per Tenancy with an Annual Rent of Less than £50,000):

This is equal to five weeks worth of rent. This covers damages, variations from the ingoing inventory (above fair wear and tear) and defaults on the part of the tenant during the tenancy.

Unpaid Rent:

Interest will be charged on any unpaid rent at 3% above the Bank of England Base Rate from the rent due date until the date the rent is paid in full, this interest charge is made to cover the cost of pursuing the non-payment of rent. This will not be levied until the rent is more than 14 days in arrears but will be charged retrospectively.

Lost Keys(s) or other Security Device(s):

Tenants are liable to the actual cost of replacing any lost key(s) or other security device(s). If the loss results in locks needing to be changed, the actual cost of a locksmith, new lock and replacement keys for the Tenant, Landlord and Agent will also be the Tenants responsibility. If the Agent is required to arrange these works the Tenant will also be responsible for the cost of the Agents time taken to replace the lost key(s) or other security device(s) at a charge of £15 including VAT per hour plus the cost of the Tradesman Invoice.  

Variation of Contract (Tenants Request):

£50 including VAT per agreed variation, to cover the costs associated with taking the Landlord’s instructions as well as preparing and executing the new legal documents as appropriate.

Change of Sharer (Tenants Request):

£50 including VAT per replacement tenant or any other reasonable costs incurred if higher. This covers the costs associated with taking the Landlord’s instructions, referencing of the new tenant including the Right to Rent checks, re-registration of the deposit as well as preparing and executing the new legal documents as appropriate.

Early Termination (Tenants Request):

Should the tenant wish to leave their contract early, they shall be liable for the Landlords costs in re-letting the property a well as all rent due under the tenancy until the start of the replacement tenancy. These costs will be no more than the maximum amount of rent outstanding on the tenancy.

Contractual Damages:

Contractual damages in the event of the Tenants default of any clause in the Tenancy Agreement, this shall be the full balance of any Tradesman Invoice, payable on receipt of invoice.

Utilities and Contracts:

Tenants are liable for the costs of all the utility supplies (unless agreed as part of a rent payment), council tax, TV license and communication services eg. Telephone and broadband.
